How to Open a HUF Demat Account in India (2026): Step-by-Step Guide - featured image

Many Indian families hold ancestral property or pooled savings but invest only in individual names. If your family qualifies as a Hindu Undivided Family, opening a dedicated HUF Demat account lets you invest as a separate legal entity, with its own PAN, tax slab, and deductions.

This guide covers the documents you need, each step in the process, what charges to expect, and the mistakes that most first-time applicants make.

What Is a HUF Demat Account?

A Hindu Undivided Family (HUF) is a legal entity under Indian tax law, recognised separately from its individual members. It can own assets, earn income, and file its own tax return. A HUF Demat account is a securities holding account opened in the HUF’s name, managed by the Karta (typically the eldest male member), to hold stocks, mutual funds, ETFs, and bonds.

The HUF and each family member are taxed independently. Under the new tax regime, the HUF gets a basic exemption of ₹4 lakh, separate from what any individual member gets. Under the old tax regime, this exemption is ₹2.5 lakh.

As per SEBI’s circular dated August 13, 2025, a HUF Demat account can now be opened jointly with individual joint holders, the same way a standard Demat account supports joint holding. This gives families additional flexibility in managing the account. Check with your broker whether they have enabled this option.

Documents Required

For the HUF entity:

  • HUF PAN card (with HUF seal and Karta’s signature)
  • HUF Declaration Deed listing the Karta and all coparceners
  • HUF bank statement not older than 3 months as address and bank proof
  • Cancelled cheque with the HUF name printed on it
  • CA-certified net worth statement or latest ITR as income proof

For the Karta:

  • Self-attested PAN card
  • Aadhaar card
  • Passport-sized photograph

Step-by-Step Process

Step 1 — Draft the HUF Declaration Deed

Write a deed that clearly states the HUF name (e.g., Ramesh Kumar HUF), the Karta’s name and role, and the names of all coparceners with their relationships. Get it notarised. Every subsequent step, PAN, bank account, and Demat, depends on this document.

Step 2 — Apply for a HUF PAN Card

Use Form 49A on the Protean eGov (formerly NSDL) or UTIITSL portal. Submit the HUF deed and the Karta’s identity proof. PAN is typically issued within 7–15 working days. This PAN is entirely separate from the Karta’s personal PAN.

Step 3 — Open a HUF Bank Account

Visit any bank with the HUF PAN, declaration deed, and Karta’s KYC documents. The account name must explicitly say “HUF”, for example, Ramesh Kumar HUF, not just the Karta’s personal name. This bank account will be linked to the Demat account.

Step 4 — Choose a SEBI-Registered Broker

Select a broker that supports HUF account opening. Most major discount brokers in India do. Confirm that the broker opens both a Demat account (to hold securities) and a trading account (to buy and sell) under the HUF; you need both.

HUF Demat accounts carry an Annual Maintenance Charge (AMC), and unlike individual accounts, there’s no zero AMC demat account route available here. Basic Services Demat Account (BSDA) eligibility, which lets individual investors get AMC down to zero for smaller holdings, explicitly excludes HUFs, companies, and trusts under SEBI rules, regardless of your HUF’s portfolio size.

Step 5 — Fill Out the HUF Account Opening Form

This form is separate from the standard individual form. Enter:

  • The HUF PAN exactly as it appears on the PAN card
  • The full HUF name, must match PAN records character-for-character
  • Date of HUF formation as per the declaration deed
  • Karta’s personal PAN and KYC details

Upload all documents in the format specified by the broker. Rejected documents are the most common reason for delays.

Step 6 — Complete Video KYC or IPV

The Karta completes identity verification either through a video call with the broker’s representative or an in-person visit to a branch with original documents.

Step 7 — Submit the Nomination Form

Before e-signing, submit the HUF nomination form or formally opt out of nomination. Under SEBI’s rules, effective June 2025, Demat accounts without a valid nomination or opt-out declaration can be frozen for debits. Do not skip this step.

Step 8 — E-Sign and Submit

The Karta e-signs the account opening form using Aadhaar-based OTP. Once submitted, the account is typically activated within 48 working hours.

What Happens When the Karta Changes?

If the Karta passes away or steps down, the next senior coparcener takes over as the new Karta. You must:

  • Inform the broker in writing with supporting documents (death certificate, if applicable)
  • Submit fresh KYC for the incoming Karta
  • Update the HUF bank account mandate accordingly

Until the broker processes this update, the account remains frozen for transactions. Complete this paperwork without delay to avoid disruption to the family’s investments.

6 Mistakes to Avoid

  • Using the Karta’s personal PAN instead of the HUF PAN. The HUF must have its own PAN. Using the wrong PAN leads to immediate rejection.
  • Opening the bank account in the Karta’s personal name. The account must explicitly show the HUF name, not just the Karta’s personal name.
  • HUF name mismatch across documents. The name on the PAN card, declaration deed, and bank account must be identical, even a spacing difference can trigger rejection.
  • Not notarising the declaration deed. Most brokers and banks expect a notarised deed. Skipping this adds unnecessary back-and-forth during verification.
  • Skipping the SEBI nomination step. Not submitting a nomination form or opt-out declaration during account opening can result in the account being frozen for debits under SEBI’s June 2025 rules.
  • Mixing HUF and personal funds. Depositing personal savings into the HUF bank account, or vice versa, creates compliance problems during ITR filing and can attract income tax scrutiny.

Who Should Open a HUF Demat Account?

This structure works well for families with ancestral property, inherited corpus, or shared savings that generate at least ₹4–5 lakh in investment income annually. Below that level, the administrative effort, separate PAN, separate ITR, broker updates, tends to outweigh the tax saving.

Non-Hindu families are not eligible, as HUF is a concept specific to Hindu personal law. Muslims and Christians cannot form a HUF under Indian law.

Opening a HUF Demat account is straightforward once you have the declaration deed, HUF PAN, and HUF bank account ready. Most brokers activate the account within 48 working hours.

The benefit is real only when the HUF earns ₹4–5 lakh or more annually, below that, the compliance effort outweighs the tax saving.

Before you start, consult a Chartered Accountant. A well-maintained HUF saves tax legally. A poorly maintained one invites scrutiny.
