NCLAT Upholds NCLT Demat Powers
The National Company Law Appellate Tribunal dismissed appeals filed by BSE challenging NCLT powers to defreeze demat accounts of companies undergoing insolvency resolution and liquidation proceedings under the IBC framework.
A two member bench held NCLT has jurisdiction under Section 60(5) of the Insolvency and Bankruptcy Code to hear applications for defreezing demat accounts during insolvency and issue directions there.
BSE argued NCLT lacked jurisdiction as issues fall under securities laws and Sebi regulations involving defaults by Future Corporate Resources and Liz Traders over listing fees fines and other dues.
Resolution professionals approached NCLT after BSE refused defreezing seeking to sell shares in frozen accounts to recover dues as part of insolvency process for the concerned companies under applicable provisions.
NCLAT upheld earlier NCLT orders directing BSE to lift freeze stating IBC overrides conflicting laws and NCLT can handle dues connected with insolvency as they qualify as debt under law provisions.
